Brown v. Krokos

United States District Court, M.D. Pennsylvania

July 1, 2015

ELIJAH BROWN, Plaintiff,
v.
CHRISTOPHER KROKOS, et al., Defendants.

Hon. Susan E. Schwab, J.

ORDER

John E. Jones III United States District Judge

AND NOW, upon consideration of the Report and Recommendation (Doc. 41) of United States Magistrate Judge Susan E. Schwab, recommending that the Defendants’ Motion to Dismiss (Doc. 32) be granted and that Plaintiff’s claims be dismissed because they are barred by collateral estoppel, and noting that Plaintiff has not filed objections and that there is no clear error on the record, [1] see Nara v. Frank, 488 F.3d 187, 194 (3d Cir. 2007) (explaining that “failing to timely object to [a report and recommendation] in a civil proceeding may result in forfeiture of de novo review at the district court level”) and the Court finding Judge Schwab’s analysis to be thorough, well-reasoned, and fully supported by the record

IT IS HEREBY ORDERED THAT:

1. The Report and Recommendation (Doc. 41) of Magistrate Judge Schwab is ADOPTED in its entirety.

2. The Defendants’ Motion to Dismiss (Doc. 32) is GRANTED.

3. This matter is DISMISSED with prejudice.

4. The Clerk of Court is directed to CLOSE this case.
