1. The Report and Recommendation is APPROVED and ADOPTED.

2. The Petition for Writ of Habeas Corpus, filed pursuant to 28 U.S.C. §2254, is DENIED AND DISMISSED WITHOUT AN EVIDENTIARY HEARING.
