ORDER

AND NOW, this 28th day of September, 2011, upon consideration of the Report and Recommendation of United States Magistrate Judge Martin C. Carlson (Doc. 12), recommending that the Petition for Writ of Habeas Corpus (Doc. 1) be granted in part, and, following an independent review of the record and noting that pro se petitioner filed objections*fn1 to the report on August 22, 2011 (Doc. 13), and the Court finding Judge Carlson's analysis to be thorough and well-reasoned, and the court finding petitioner's objections*fn2 to be without merit and squarely addressed by Judge Carlson's report (Doc. 12), it is hereby ORDERED that:

1. The Petition for Writ of Habeas Corpus (Doc 1) is GRANTED, in part.

2. This matter is REMANDED to the applicable BOP Disciplinary Hearing Officer (DHO) for further disciplinary proceedings that provide Petitioner with adequate and timely notice, and a timely and complete statement of reasons for the agency's actions.

3. The Clerk of Court is directed to CLOSE this matter.
