AND NOW, this 7th day of February, 2011, upon review and consideration of Jane C. Orie's Emergency Application for Extraordinary Relief and Stay of Proceedings, and the response of the Commonwealth thereto, the application is DENIED.

Madame Justice Orie Melvin did not participate in the consideration or decision of this matter.

Mr. Justice Saylor dissents, as he would grant Petitioner's request to exercise jurisdiction pursuant to Section 726 of the Judicial Code, see 42 Pa.C.S. §726, to determine whether the seizure of records from Petitioner's legislative office violated general separation-of-powers principles and/or the privileges afforded by the Speech and Debate Clause of the Pennsylvania Constitution. See Pa. Const. art. II, §15.
