AND NOW, this 18th day of November, 2010, in accordance with the Memorandum Opinion filed this day, upon consideration of this Petition for Writ of Habeas Corpus filed pursuant to 28, United States Code, § 2254, the respondents' motion to dismiss the petition (Doc. 51) and the petitioner's motion to vacate (Doc. 56) IT IS ORDERED as follows:

1. The respondents' motion to dismiss (Doc. 51) is GRANTED, the Petition is DENIED, and we find that a certificate of appealability should not issue.

2. The petitioner's Motion to vacate (Doc. 56) is DENIED.

3. The clerk is directed to close this file.
