ORDER

AND NOW, this 16th day of November, 2010, upon consideration of the report of the magistrate judge (Doc. 12), recommending that the complaint be dismissed with prejudice and that the file be closed for plaintiff's failure to file an amended complaint or a motion for extension of time by June 29, 2010 (Doc. 11), and, following an independent review of the record and noting that defendant filed a "response" to the report on August 19, 2010 (Doc. 13)*fn1, which response is wholly without merit, it is hereby ORDERED that:

1. The report of the magistrate judge (Doc. 12) is ADOPTED.

2. The Clerk of Court is instructed to CLOSE this case.
