MEMORANDUM

I. INTRODUCTION

The instant action was instituted by the plaintiffs, Jona and Daniel Diehl, on January 12, 2010, by the filing of a complaint pursuant to the Family Medical Leave Act ("FMLA"), 29 U.S.C. § 2601, et seq., and the First and Fourteenth Amendments of the United States Constitution.*fn1 (Rec. Doc. No. 1). Named as defendants are Melinda Knepp, the secretary to Brandy Yasenchak, the District Court Administrator for the Court of Common Pleas of Northumberland County;
