AND NOW, this 25th day of May, 2010, upon consideration of the Recommendation of the Three-Member Panel of the Disciplinary Board dated March 23, 2010, the Joint Petition in Support of Discipline on Consent is hereby granted pursuant to Rule 215(g), Pa.R.D.E., and it is
ORDERED that William A. Mitchell be subjected to public censure by the Supreme Court and that he be placed on probation for a period of one year, subject to the following conditions:
(1) Respondent shall comply with all federal and state tax laws during the period of probation.
(2) Respondent shall comply with the terms arranged by the IRS for the payment of any outstanding taxes, penalties and interest.
(3) Respondent shall not unlawfully possess a controlled substance.
(4) Stuart Burstein, M.D., is appointed as Respondent's mental health monitor. The monitor shall perform the following during the period of Respondent's probation:
a. monitor compliance by Respondent with the terms and conditions of the order imposing probation;
b. assist Respondent in arranging any necessary professional or substance abuse treatment with Freedom Healthcare Services;
c. meet with Respondent at least twice a month and maintain weekly telephone contact with him;
d. maintain direct contact with the Respondent's Narcotics Anonymous/Alcoholics Anonymous sponsor if he participates in either of those programs;
e. file with the Secretary of the Board quarterly written reports; and
f. immediately report to the Secretary of the Board any violations by Respondent of the terms and conditions of probation.
