1. The Report and Recommendation is APPROVED and ADOPTED , and

2. The habeas petition is DISMISSED WITHOUT PREJUDICE , and

3. There is no basis for the issuance of a certificate of appealability.

IT IS FURTHER ORDERED that Petitioner's Motion for Order (Doc. 12) and Petitioner's Motion for Summary Judgment (Doc. 15) are DENIED .
