AND NOW, this 23rd day of March, 2010, upon consideration of the report of the magistrate judge (Doc. 9), recommending that the above-captioned matter be transferred to the Western District of Pennsylvania, and, following an independent review of the record, it appearing that plaintiff's complaint stems from incidents which occurred in Allegheny County, and that Allegheny County is located within the jurisdiction of the United States District Court for the Western District of Pennsylvania, see 28 U.S.C. § 118(c), and it further appearing that in the interest of justice a district court has the authority to "transfer any civil action to any other district or division where it might have been brought," see id § 1404(a); Lafferty v. St. Reil, 495 F.3d 72, 82 (3d Cir. 2007), and that plaintiff has not filed objections to the magistrate judge's report and recommendation, and the court concluding that there is no clear error on the face of the record,*fn1 see Nara v. Frank, 488 F.3d 187, 194 (3d Cir. 2007) (explaining that "failing to timely object to [a report and recommendation] in a civil proceeding may result in forfeiture of de novo review at the district court level"), it is hereby ORDERED that:
1. The report and recommendation (Doc. 9) of the magistrate judge is ADOPTED.*fn2
2. The above-captioned matter is TRANSFERRED to the United States District Court for the Western District of Pennsylvania.
3. The Clerk of Court is directed to CLOSE this case.
