ORDER

Before the court is Plaintiffs' motion for additional time to file Plaintiffs' affidavits in support of their claim of damages. (Doc. 136.) In consideration thereof, IT IS HEREBY ORDERED THAT Plaintiffs' motion is GRANTED. By no later than February 26, 2010, Plaintiffs' counsel shall file an affidavit from each Plaintiff supporting his or her claim for damages. Defendant shall have twenty days from receipt of these affidavits to object to them, and provide evidence of its own on the issue of damages.

In the alternative, Defendant can request to have a hearing for the purpose of cross-examining any or all Plaintiffs on his or her damages claim. If Defendant does not respond within twenty days from receipt of the affidavits, or a longer period if so ordered by the court, and if Plaintiffs' affidavits are admissible, the court will resolve Plaintiffs' damages claim without the need for a hearing.
