ORDER

AND NOW, this 13th day of January, 2010, in response to the Petition for Leave to File Petition for Allowance of Appeal Nunc Pro Tunc, this matter is REMANDED to the trial court for it to determine whether Petitioner is indigent and is entitled to appointment of counsel. If the trial court determines that Petitioner is entitled to court-appointed counsel, counsel shall file a Petition for Allowance of Appeal within 60 days of appointment.
