ORDER

AND NOW,this 27th day of May , 2009, upon consideration of the Petition for a Writ of Habeas Corpus and Declaratory Judgment, after careful review of the Report and Recommendation of Magistrate Judge Jacob P. Hart filed on April 22, 2009, and Petitioner having filed no objections to the Report and Recommendation, it is ORDERED as follows:

1. The Report and Recommendation is APPROVED and ADOPTED.

2. The Petition For Writ Of Habeas Corpus and Declaratory Judgment is DENIED.

3. There is no basis for the issuance of a certificate of appealability. IT IS SO ORDERED.
