MEMORANDUM

Steven Watkins, an inmate confined at the State Correctional Institution at Frackville, Pennsylvania, filed this petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. He has paid the required filing fee. In the petition, Watkins maintains that he was denied due process with regard to a decision of the Pennsylvania Board of Probation and Parole ("PBPP") denying him parole on February 13, 2008.

I. Background

On November 12, 1986, Petitioner was sentenced to 2 to 6 years for aggravated assault. His minimum date on that sentence was May 11, 1988 and his original maximum date was May 11, 1992. He was paroled from this sentence at his minimum date - May 11, 1988. Petitioner was only on parole a few months when he was arrested on September 26, 1988 for burglary. He was also subsequently charged with 2 counts of rape and robbery.
