AND NOW, this 22nd day of January, 2007, upon consideration of the report of the magistrate judge (Doc. 34), recommending the granting of summary judgment in favor of defendant on plaintiff's Pennsylvania Human Relations Act, 43 PA. CONS. STAT. ANN. § 951, Age Discrimination in Employment Act, 29 U.S.C. §§ 621 - 634, and Americans with Disabilities Act ("ADA"), 29 U.S.C. §§ 12101 - 12213, claims, to which objections were filed,*fn1 and, following an independent review of the record, the court finding that plaintiff did not establish a prima facie case of discrimination under the ADA,*fn2 it is hereby ORDERED that:
1. The report and recommendation of the magistrate judge (Doc. 34) is ADOPTED.
2. Defendants' motion for summary judgment (Doc. 19) is GRANTED. See FED. R. CIV. P. 56(c).
3. The Clerk of Court is directed to CLOSE this case.
