NOW, this 7th day of April 2004, upon consideration of
Defendants', Razi Foods of New Jersey, Inc. t/d/b/a Rentucky Fried
Chicken a/k/a RFC; RFC Corporation and Yum! Brands, Inc. f/k/a Tricon
Global Restaurants, Inc., Motion for Summary Judgment, which motion was
filed on February 27, 2004; the Reply of Plaintiff, Maria Vega Pacheco,
in Opposition to Defendants' Motion for Summary Judgment, which reply was
filed on March 12, 2004; and the Second Supplement to Defendants', Razi
Foods of New Jersey, Inc. t/d/b/a Kentucky Fried Chicken, a/k/a RFC and
RFC Corporation; and Yum Brands, Inc., f/k/a Tricon Global Restaurants,
Inc., Brief in Support of Motion for Summary Judgment, which supplement
was filed on March 31, 2004; and for the reasons expressed in the
IT IS ORDERED that defendants' motion is granted in part and
denied in part. IT IS FURTHER ORDERED that judgment is entered in favor of
defendant KFC Corporation and defendant Yum! Brands, Inc. and against
plaintiff on Counts I and II of the Complaint.
IT IS FURTHER ORDERED that judgment is entered in favor of
all defendants and against plaintiff on Count V of the Complaint.
IT IS FURTHER ORDERED that in all other respects defendants'
motion is denied.
