of Defendants, City of Bethlehem and Dana B. Grubb's Motion for
Summary Judgment filed August 15, 2003; upon consideration of Plaintiff's
Memorandum of Law in Opposition to Defendants' Motion for Summary
Judgment filed September 18, 2003; upon consideration of the briefs of
the parties; upon consideration of the pleadings, exhibits, depositions
and record papers; and for the reasons expressed in the accompanying
IT IS ORDERED that defendant's motion for summary judgment is
granted in part and denied in part.
IT IS FURTHER ORDERED that defendants' motion for summary
judgment is granted concerning Counts I, II and III of plaintiff's
IT IS FURTHER ORDERED that Counts I, II and III are
dismissed from plaintiff's Amended Complaint filed May 24, 2002.
IT IS FURTHER ORDERED that in all other respects defendants'
motion for summary judgment is denied.
