After consideration of all contentions raised by the appellant, to wit:

1. That the Court abused its discretion in permitting the government to benefit from a violation of the Court's sequestration order;

2. That the lower Court committed error in denying defendant's motions for judgment of acquittal and for new trial based upon material variance; it is

ADJUDGED AND ORDERED that the judgment of the district court be and is hereby affirmed.
