2. This Order is being entered without prejudice to appellant being able to move in the district court pursuant to Fed. R. Civ. P. 60(b)(5) for relief from the judgment of the district court at the conclusion of the proceedings on appeal in Commonwealth v. Parsell, 00787HG90, pending in the Superior Court of Pennsylvania.
3. Costs taxed against appellant.
