ORDER

LOUIS H. POLLAK, UNITED STATES DISTRICT JUDGE

 For the reasons stated from the bench at the September 25, 1989 hearing, it is hereby ORDERED and DIRECTED that:

 1. defendant's motion to dismiss is GRANTED as to Counts I, II and III of the complaint;

 2. the remaining counts of the complaint, which concern state law causes of action, are DISMISSED for want of federal jurisdiction; and

 3. plaintiffs' motion for class certification is DENIED as MOOT.
