COMMONWEALTH PENNSYLVANIA v. MICHAEL THEODORE SALINA (09/28/87)

SUPERIOR COURT OF PENNSYLVANIA

filed: September 28, 1987.

COMMONWEALTH OF PENNSYLVANIA
v.
MICHAEL THEODORE SALINA, APPELLANT

Appeal from the Judgment of Sentence of February 20, 1987 in the Court of Common Pleas of Blair County, Criminal Division, at Nos. 1, 64, 129, 130 & 143 of 1986.

Cirillo, P.j., Hoffman, And Hester, JJ. Cirillo, P.j., files a Dissenting Statement.

Order PER CURIAM

We enter the following order: appellant's counsel is directed to file, within thirty (30) days of the date of this order, a concise supplement to appellant's brief addressing the concerns expressed by our Supreme Court in Commonwealth v. Tuladziecki, Pa. , 522 A.2d 17 (1987). Should counsel fail to comply with this order, appellant's petition for allowance of appeal will be denied. Jurisdiction of the Superior Court and this panel is retained.

ING STATEMENT BY CIRILLO, P.J.:

I respectfully dissent. Appellant has failed to set forth in his brief a concise statement of the reasons relied upon for allowance of appeal. See Pa. R.A.P. 2116(b); 2119(f). Furthermore, appellant has not filed a petition to supplement his brief. Pursuant to Commonwealth v. Tuladzeicki, Pa. , 522 A.2d 17 (1987), I would quash this appeal.
