MEMORANDUM:

Per Curiam:

This is an appeal from a preliminary injunction restraining Commonwealth Bancshares Corporation, appellant, from acquiring or attempting to acquire "any shares of Heritage Financial Services Corporation until and unless the [appellant] obtains approval for such acts from the Pennsylvania Department of Banking as required under Section 112 of the Pennsylvania Banking Code." At the time of argument, it was agreed that the Pennsylvania Department of Banking has now granted such approval. Therefore, the preliminary injunction has expired according to its own terms and is no longer of any effect. Under these circumstances, the present appeal is moot. There is no need for us to determine whether the preliminary injunction was correctly issued.

Disposition

Appeal quashed.
