SUPERIOR COURT OF PENNSYLVANIA

filed: June 23, 1986.

COMMONWEALTH OF PENNSYLVANIA
v.
MARK A'BRIAL, APPELLANT

Appeal from the Judgment of Sentence of November 26, 1984 in the Court of Common Pleas of Bucks County, Criminal, No. 1738, 1738-01/1983.

Before: McEWEN, Montemuro and Tamilia JJ.

Per Curiam:

The argument that a new trial is required by reason of trial errors are rejected. The claim that a new trial is required by reason of the ineffective assistance of counsel is denied. The judgment of sentence is, however, vacated and the case remanded so as to enable the trial court to conduct an evidentiary hearing upon the aforespecified claims of ineffective assistance of counsel and determine whether a new trial is required by reason of such claims. Jurisdiction is relinquished.
