Appeal from the Judgment entered on March 1, 1985 in the Court of Common Pleas, Washington County, Civil, at No. 124 April Term, 1982.

Before: Wieand, Del Sole And Hester, JJ.

Per Curiam:

The judgment is vacated and the case is remanded to the trial court to consider and determine the effect of the release executed by the plaintiff-appellee. If it is determined that the release bars recovery against appellant, the trial court shall enter judgment in favor of the appellant. If, on the other hand, it is determined that the release does not bar recovery, judgment shall again be entered in favor of the appellee in accordance with the order of Judge Thomas D. Gladden dated February 8, 1985.

Disposition

REMANDED.
