January 6, 1986
UNITED STATES OF AMERICA
THOMAS DICICCO, APPELLANT
Criminal Action No. 83-00314-10, District Judge: Honorable John B. Hannum
BEFORE: SEITZ, WEIS and ROSENN, Circuit Judges.
After consideration of the contentions raised by appellant, to-wit, that the trial court erred (1) in denying defendant's motion for acquittal because of insufficiency of the evidence to convict the defendant of conspiracy and (2) in finding that certain of the defendant's co-conspirators were unavailable to testify at trial, and it appearing to this court that the evidence overwhelmingly supports the conviction on the conspiracy count, it is
ADJUDGED AND ORDERED that the judgment of the district court be and is hereby affirmed.
