COMMONWEALTH PENNSYLVANIA v. THOMAS LEE EVANS (07/19/85)

SUPERIOR COURT OF PENNSYLVANIA

July 19, 1985

COMMONWEALTH OF PENNSYLVANIA
v.
THOMAS LEE EVANS, APPELLANT

Appeal from the Order January 24, 1984 in the Court of Common Pleas of Berks County, Criminal, No. 78086901-7.

Before McEWEN, Cirillo and Hester, JJ.

Per Curiam:

The order of the PCHA court denying appellant's pro se PCHA petition is vacated and the case is remanded for the appointment of counsel. Only after counsel has had an opportunity to review and amend the petition should a decision be made as to whether to grant a hearing. If the court finds that the issues raised at that time have been finally litigated, a hearing would, of course, not be required. Jurisdiction is relinquished.
