VICTORIA M. WELSH v. MICHAEL J. WELSH (06/08/84)

SUPERIOR COURT OF PENNSYLVANIA

June 8, 1984

VICTORIA M. WELSH
v.
MICHAEL J. WELSH, APPELLANT

No. 64 Harrisburg, 1982, Appeal from the Order of January 14, 1982 in the Court of Common Pleas of Dauphin County, Civil Division, No. 3903 S. 1980

Before Wickersham, Wieand, and Cercone, JJ. Wieand, J. files a Concurring Memorandum.

Per Curiam:

Order of the lower court is affirmed.

WIEAND, J. files a Concurring Memorandum.

WIEAND, J.:

I concur in the result achieved by the majority. I write separately only to disassociate myself from that portion of the majority's Memorandum which seems to suggest that an award of counsel fees in a divorce action may be based upon the fault of the parties in causing the marital breakup. I continue to be of the opinion that "the award of counsel fees is not to punish one spouse nor reward the other." Hoover v. Hoover, 288 Pa. Super. 159, 161, 431 A.2d 337, 338 (1981).
