IN RE: APPOINTMENT OF DEPUTY CONSTABLE FOR BRISTOL TOWNSHIP, BUCKS COUNTY, PENNSYLVANIA; APPEAL OF: COMMONWEALTH OF PENNSYLVANIA
No. 356 Philadelphia 1982, Appeal from the Order entered January 20, 1982, Court of Common Pleas, Bucks County, Criminal Division at No. 77 M.M. 1980.
Before Cirillo, Johnson and Cercone, JJ.
The Commonwealth brings this appeal from an order entered by the Court of Common Pleas of Bucks County approving the appointment of a deputy constable by the duly elected constable of Bristol Township in that county. After a full hearing, the court found that the testimony elicited on behalf of the petition met the requirements necessary to justify that court's approval of the appointment of a deputy constable.
The sole power to appoint a deputy constable in any township is vested in the constable of such township, subject to the approval of the court of common pleas. Act of June 19, 1913, P.L. 534, § 1, 13 P.S. § 21.*fn1 We find no abuse of discretion by the distinguished hearing judge, the Honorable Paul R. Beckert, P.J.
