COMMONWEALTH PENNSYLVANIA v. JEFFREY SPIEGEL (02/18/83)

SUPERIOR COURT OF PENNSYLVANIA

February 18, 1983

COMMONWEALTH OF PENNSYLVANIA
v.
JEFFREY SPIEGEL, APPELLANT

NO. 2175 PHILADELPHIA, 1981, Appeal from the PCHA Order of July 08, 9181, in the Court of Common Pleas of Bucks County, Criminal Division, at No. 672 of 1979.

Before Spaeth, Brosky and Beck, JJ. Spaeth, J. files a concurring statement.

Per Curiam:

Order affirmed.

Spaeth, J. files a concurring statement.

SPAETH, J.:

I should affirm on the ground that the information was signed by the District Attorney. It is unnecessary to discuss Commonwealth v. Veneri, Pa. Super. , A.2d (1982). Moreover, Veneri does not, as the majority suggests it does, stand for the proposition that once the defendant has pleaded guilty or been convicted, it doesn't matter that the information wasn't signed.

I therefore concur in the result reached by the majority.
