Order reversed.

The record is remanded to the court below for a hearing on appellant's petition.

HESTER, J.:

I dissent. I would affirm on the opinion of Judge Dillon of the court below. The record indicates that appellant decided to permit his plea to stand after the court refused to accept the plea bargain due to appellant's 15 year history of criminal activity. The possible sentences were outlined in detail by the court. I would affirm.
